1. Introduction

Welcome to Bail.

These Terms of Use (“Terms”) govern your access to and use of the Bail mobile application and related services (“Bail”, “we”, “us”).

By creating an account or using Bail, you agree to these Terms.

If you do not agree, you must not use the app.

2. Who Can Use Bail

  • You must be at least 16 years old to use Bail
  • If local law sets a higher digital age of consent, that higher age requirement applies
  • You must provide accurate information when creating an account

3. Your Account

You are responsible for:

  • Maintaining access to your account
  • All activity under your account

You agree not to:

  • Impersonate others
  • Create fake or misleading accounts
  • Use Bail for illegal or harmful purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

4. How Bail Works

Bail is a social platform for action sports users to:

  • Share photos and videos
  • Log sessions and locations
  • Discover skate spots
  • Interact with other users

Features may change over time.

5. User Content

5.1 Ownership

You retain ownership of the content you create and upload.

5.2 License to Bail

By posting content on Bail, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Host and store your content
  • Display and share it within the app
  • Process it (e.g. video encoding, thumbnails)
  • Promote Bail (e.g. featured content)

This license ends when you delete your content, except where:

  • It has been shared by others
  • We must retain it for legal reasons

5.3 Responsibility

You are responsible for your content.

You must not post:

  • Illegal content
  • Hate speech or harassment
  • Pornographic or explicit content
  • Content that violates others' rights
  • Dangerous or misleading content

6. Location Features

Bail uses location data to enable:

  • Skate spot discovery
  • Session tracking

By using these features, you agree that:

  • Your activity may be associated with locations
  • Other users may see location-based content

You can stop using location features at any time.

7. Acceptable Use

You agree not to:

  • Abuse or harass other users
  • Spam or manipulate engagement
  • Attempt to hack, disrupt, or reverse engineer the app
  • Use Bail for unauthorized commercial purposes

8. Moderation

We may:

  • Remove content
  • Restrict or suspend accounts
  • Review reported content

This is done to:

  • Maintain a safe community
  • Enforce these Terms

We are not obligated to monitor all content.

9. Third-Party Services

Bail integrates with third-party services such as:

  • Apple and Google (login)
  • Mapbox (maps)

Your use of those services may also be subject to their terms.

10. Promotions & Future Features

Bail may promote:

  • Skateparks
  • Shops
  • Events

These may appear in the app (e.g. spot screens).

We may introduce additional features or monetization in the future.

11. No Guarantees

Bail is provided “as is”.

We do not guarantee:

  • The app will always be available
  • The app will be error-free
  • Content accuracy or reliability

12. Limitation of Liability

To the maximum extent permitted by law:

Bail is not liable for:

  • User-generated content
  • User behavior
  • Loss of data
  • Indirect or consequential damages

Nothing in these Terms excludes liability that cannot be excluded by applicable law, including liability for intent, gross negligence, or fraudulent misrepresentation where required.

13. Termination

You may stop using Bail at any time.

We may suspend or terminate your account if you:

  • Violate these Terms
  • Use Bail in a harmful or illegal way

14. Changes to the Terms

We may update these Terms.

If changes are significant, we will notify you in the app or via email.

Continued use of Bail means you accept the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without regard to conflict of laws principles.

Where legally permitted, disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts responsible for Panketal, Germany.

If mandatory consumer protection rules in your country of residence provide additional rights, those rights remain unaffected.
